Not to mention difficult time zones!<\/span><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">Things are much easier if your international clients are still based within the EU. Firstly, your currency remains the same, international payments are easy for your clients, you\u2019re likely to be on the same or a similar time zone, and lastly, you can take advantage of the reverse charge system (\u201cReverse Charge Verfahren\u201d).<\/span><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">The reverse charge procedure helps to simplify purchases and sales with VAT within the EU, by regulating the transfer of sales tax between sellers and customers who are based in different EU countries. This article explains all you need to know about reverse charge.<\/span><\/p>\n\n\n\n<h2 id=\"when-to-apply-the-reverse-charge\" class=\"wp-block-heading font-degular scroll-mt-32\"><span style=\"font-weight: 400;\">When to apply the Reverse Charge?<\/span><\/h2>\n\n\n\n<div>\n<div class=\"standard-markdown grid-cols-1 grid [&amp;_&gt;_*]:min-w-0 gap-3\">\n<p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">The purpose of the reverse charge rule is to simplify free trade within the EU, and it&#8217;s been in place for almost 20 years.<\/p>\n<\/div>\n<\/div>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">As a freelancer in Germany, you are permitted to service a client in another EU country. If that EU country is also subject to VAT, the reverse charge rule applies. It stipulates that it\u2019s the buyer \u2013 your client \u2013 who is obliged to pay VAT on the goods or services received, and not you. Therefore, you don\u2019t need to charge VAT on your <\/span><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/www.accountable.de\/en\/blog\/how-to-create-the-perfect-invoice-in-germany\/\"><span style=\"font-weight: 400;\">invoices<\/span><\/a><span style=\"font-weight: 400;\"> to those clients.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\">The reverse charge rule, however, does not apply when your customer is a private person. A private person pays VAT on the sale of goods or services that you provide. If you&#8217;re a <a class=\"underline underline-offset-2 decoration-1 decoration-current\/40 hover:decoration-current focus:decoration-current font-inter text-purple underline-offset-1\" href=\"https:\/\/www.accountable.de\/en\/blog\/when-is-a-freelancer-a-kleinunternehmer\/\">Kleinunternehmer<\/a>, the reverse charge rule still applies when you provide services to a VAT-registered business in another EU country. In this case, you issue an invoice without VAT and reference the reverse charge procedure \u2014 just as any other freelancer would. Your EU client then accounts for the VAT in their own country. What the Kleinunternehmer status changes is only that you don&#8217;t charge VAT on domestic sales in Germany \u2014 it does not exempt you from the reverse charge obligation on intra-EU B2B service transactions.<\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><b>Consider these examples of how reverse charge works in practice:<\/b><\/p>\n\n\n\n<ul class=\"wp-block-list list-disc list-outside ml-0 mb-4 space-y-2\">\n<li class=\"font-inter text-base text-black\"><span style=\"font-weight: 400;\">Let&#8217;s say that you, a self-employed individual in Germany, teach a training course for a French company. You do not charge sales tax on the invoice that you issue to your French client. You state the reverse charge procedure as the reason that VAT is not shown. Your French client will then report, pay, and deduct VAT on your services in their country as part of their VAT reporting procedure.<\/span><\/li>\n\n\n\n<li class=\"font-inter text-base text-black\"><span style=\"font-weight: 400;\">You buy a monitor for your computer from a company in Poland, which is delivered to you in Germany. You pay the sales tax for it, but you can claim it back as an expense in your <\/span><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/www.accountable.de\/en\/blog\/how-to-file-your-german-vat-return\/\"><span style=\"font-weight: 400;\">VAT return<\/span><\/a><span style=\"font-weight: 400;\"> &#8211; if it is considered a <\/span><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/kannichdasabsetzen.accountable.de\/en\/\"><span style=\"font-weight: 400;\">business expense<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n\n\n\n<h2 id=\"what-must-be-included-in-an-invoice-for-reverse-charge-to-be-applicable\" class=\"wp-block-heading font-degular scroll-mt-32\"><span style=\"font-weight: 400;\">What must be included in an invoice for reverse charge to be applicable?<\/span><\/h2>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">In order to send a legally compliant invoice as a freelancer in Germany, your invoices must include specific information about you, your client, and the service or product you delivered.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">In order to effectively apply the reverse charge rule, your invoice must include your <\/span><a class=\"font-inter text-purple underline underline-offset-1\" href=\"https:\/\/www.accountable.de\/en\/blog\/freelancing-in-germany-heres-what-you-need-to-know-about-tax-numbers\/\"><span style=\"font-weight: 400;\">VAT ID number<\/span><\/a><span style=\"font-weight: 400;\">, as well as a clear statement referring to the reverse charge procedure somewhere on the invoice. This ensures that your customer can declare and reclaim the VAT when they complete their own reports. The clearest way to do this in German is by adding the statement \u201cSteuerschuldnerschaft des Leistungsempf\u00e4ngers\u201d. Any invoices you receive for goods or services you pay for should also include specific information, especially if the reverse charge rule is applied.<\/span><\/p>\n\n\n\n<h2 id=\"do-i-have-to-include-reverse-charge-invoices-in-my-advance-vat-return\" class=\"wp-block-heading font-degular scroll-mt-32\"><span style=\"font-weight: 400;\">Do I have to include reverse charge invoices in my advance VAT return?<\/span><\/h2>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">Short answer: Yes! You should include all of your freelance income in your advance VAT return (\u201cUmsatzsteuervoranmeldung\u201d), and that includes any sales or expenses that fall under the reverse charge procedure.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">Invoices where the reverse charge rule was applied fall under point 3 of the advance VAT return, tax-free deliveries of sales and other services (\u201c<\/span><i><span style=\"font-weight: 400;\">Lieferungen und sonstige Leistungen [steuerfreie Ums\u00e4tze]\u201d)<\/span><\/i><span style=\"font-weight: 400;\">. This won&#8217;t affect the amount of VAT that you pay, but it can be used by the tax authorities to ensure your client actually pays the VAT due in their own country.<\/span><\/p>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">You must also include these transactions when you submit the summary report (\u201c<\/span><i><span style=\"font-weight: 400;\">Zusammenfassende Meldung<\/span><\/i><span style=\"font-weight: 400;\">\u201d). In this report, you\u2019ll list all sales made to EU countries, in individual items, broken down by client. You also need the respective VAT IDs for your clients for this, which you can request when you first ask for their address and other details.<\/span><\/p>\n\n\n\n<h2 id=\"does-reverse-charge-also-apply-to-customers-in-countries-outside-of-the-eu\" class=\"wp-block-heading font-degular scroll-mt-32\"><span style=\"font-weight: 400;\">Does reverse charge also apply to customers in countries outside of the EU?<\/span><\/h2>\n\n\n\n<p class=\"font-inter text-base leading-relaxed mb-4 first-of-type:mt-0 text-black wp-block-paragraph\"><span style=\"font-weight: 400;\">In general, if your customer is not in the European Union, no VAT is charged or paid. However, there are some countries that have specific agreements with Germany that regulate the rules of sales tax in a similar way to the reverse charge procedure.
